Getting the Facts Straight on Senator Roger Marshall

Senator Roger Marshall has been fiercely attacked over the last few weeks by Adam Hamilton’s campaign and by local and national media. With little fact checks available to counter the claims of Marshall’s opposition, it’s important for Kansas voters to know the truth.

Last month, Hamilton’s campaign ran an emotionally charged ad featuring a woman who claimed that she was arrested while eight months pregnant for missing a $50 medical payment to Marshall. The New York Times picked up the woman’s story and the stories of hundreds of women allegedly sued by Marshall’s practice over medical debts. The narrative from The New York Times is that Marshall is a cruel doctor preying upon vulnerable patients, suing them and throwing them in jail.

But is that true?

In a cease-and-desist letter to Hamilton alleging defamation, Marshall and his lawyers laid out the facts that were concealed by Hamilton’s deceptive campaign messaging:

  • The woman in the ad (who owed $3,600 to Marshall’s practice, not just $50), wasn’t arrested for failing to make a $50 payment. She was arrested for contempt of court, for failing to appear at court after being summoned.
  • Contrary to the claims in Hamilton’s ad and the media, it is illegal for people to be arrested and thrown in jail because of medical debt.
  • For several reasons, then, it is impossible that Marshall got a woman jailed over a medical bill.

Although not all the facts regarding how Marshall’s practice pursued legal action in handling patient billing are public, it is perfectly legitimate for medical practices to collect unpaid bills, including through lawsuits.

Senator Marshall is the pro-life candidate running for reelection to the U.S. Senate, and he has received the endorsement of Kansans for Life Political Action Committee (KFL PAC). During his 25-year career as an OBGYN, Marshall delivered over 5,000 babies. As a U.S. Senator, Marshall has a 100% pro-life voting record. We can trust Marshall to vote for moms and babies.

Marshall’s political opponent, Democrat Adam Hamilton, recently stated that he voted against commonsense regulations on the abortion industry in the state, including health and safety requirements for abortion facilities and informed consent for women seeking abortions.

Hamilton still has not voiced support for ANY limits on abortion—including limits on taxpayer funding for abortion. As a U.S. Senator, Hamilton could vote to redirect your federal tax dollars to abortion through federal legislation and budget appropriations.

It’s important for pro-lifers to know the facts. Senator Marshall is the pro-life candidate who stands for moms and babies in the Senate.
